Submission Terms & Conditions
1.  ACCEPTANCE
Submissions are required to have a minimum of 6 images. The Magazine can only accept photos from the Photographer or the copyright holder. In case of the copyright owner, the Submitter shall provide a written permission from the Photographer upon submission. 
2.  PUBLICATION RELEASE
Once the Magazine issue is released, the Submitter will be communicated with a cloud storage link to download the pages. All communications made or notices given shall be conducted in the English language. The digital version will be available through our website. The Magazine shall not provide free physical copies. They can be acquired through a print on-demand site. The Magazine is not held accountable for orders through this service. 
3.  EXCLUSIVITY & PUBLICITY
All submitted photos require to be exclusive and unpublished. The Magazine will also publish the material in its communications and content channels (including website, social media platforms and email) to further promote the Submitter and its team members. 
4.  PHOTOSHOOT TITLE
The submission should include a title and/or a short description of the inspiration/concept. The Magazine reserve the rights to modify its title after acceptance to adhere to its current issue and theme.
5.  CREDITS
The Submitter shall include the names and Instagram handles for the whole production team upon the submission request, including and not limited to photographer(s), make-up artist(s), hairstylist(s), fashion designer(s), fashion stylist(s), model(s) and production assistant(s). The Submitter is solely responsible for the accuracy of all credit information, which will be published exactly as sent. Corrections may incur additional fees.
6.  RELEASES
The Submitter shall obtain all release forms, waivers, consents and rights necessary and incident to the reproduction and exhibition of the photos, including and not limited to models, production staff, clothing, materials, elements and location.
7.  ALTERATIONS
The Magazine reserves the rights to perform minimal editing of the original photos to better adjust and fit the page and spread layouts. The Magazine will not perform any drastic alteration (including color shift, mirroring, flopping) without the express permission of the Submitter.
8.  REJECTION
The Magazine reserves the rights to reject the entire submission or parts of it that are unsuitable with its overarching vision and/or direction/theme of a specific issue, including and not limited to lack of overall production quality, low imagery resolution, and/or considered unsafe, illegal, immoral or unethical. All submitted material shall not contain any watermarks and/or logos.
9.  OWNERSHIP RIGHTS
Except as otherwise provided herein, by allowing the Magazine to publish the Submitter’s work, it grants the Magazine sole and exclusive rights in perpetuity throughout the universe to use, disseminate, advertise, monetize and exploit the photos in any of the Magazine’s printed and digital content channels.
10.  INDEMNIFICATION
The Submitter agrees to indemnify, defend and hold harmless the Magazine and its officers, employees, agents and licensees from and against any and all claims, actions, losses, liabilities, costs, expenses (including reasonable attorney’s fees), fines, penalties, taxes or damages, arising out of the breach of any obligation, warranty or representation, including assertions by third parties.
In no event shall the Magazine be liable for consequential, special, indirect, incidental, punitive or exemplary damages, costs, expenses or losses (including, without limitation, lost profits and opportunity costs).
The Submitter shall indemnify the Magazine against all claims and expenses arising from uses for which the Submitter does not have rights to or authority to use. The Submitter will be responsible for payment of any special licensing or royalty fees resulting from the unauthorized use of photography, design and branded content.
11.  ELECTRONIC COMMUNICATIONS
The Submitter and the Magazine may communicate with one another through the Kavyar platform and/or by electronic mail or otherwise transmit documents in electronic form. Each party accepts the inherent risks of communication, including the security risks of interception of or unauthorized access to such communications, the risks of corruption of such communications and the risks of viruses or other harmful devices.
12.  ENFORCEABILITY
If one of more of the provisions of this Agreement shall be held unenforceable, it shall not affect the enforceability of the other provisions.
